Where the answer actually comes from

Whether a mortgage can be assumed is decided by the note itself, and the note is on file with the Essex County Register of Deeds and Mortgages in Newark. FHA and VA loans are assumable by law; a conventional loan carries a due-on-sale clause and generally is not. Until somebody reads that document, the loan type is estimated from the deed date, and every report says so on its face.
